CLAIMS AND DISPUTES


Everyone is entitled to pursue his or her legal rights in all areas of the law, by making or defending claims, or by getting good legal advice about disputes. Solicitors are trained to preserve this right, and barristers to give specialist help; judges are there to give the final decisions.

Most people would rather not have to go to court, even as witnesses. The truth is that the most cost-effective solutions to the majority of disputes are those we find by discussion and negotiation - which is why always try to find those solutions. But the fact that the courts are there as the final resort is probably essential - not only when they have to be used, but also to make people find a settlement if they can.

IF YOU HAVE TO GO TO COURT
Sometimes a settlement is too hard to find, and in rare cases one party is simply not prepared to try to settle. If all else fails and you have to face a court action, we will provide the advice and support you need.

We will consult experts when needed, draft and prepare court papers, liaise with court staff, make necessary procedural applications, and look after you throughout the case. We have access to specialist barristers when necessary.

BUT AT WHAT COST?
If you must go to Court, you may have legal expenses insurance (sometimes without realising it) which may pay our costs or we may be able to work under a Conditional Fee Agreement. However you pay for litigation we will give you frank and full information at every stage, and enable you to make proper choices.
